By accessing or using SmartPick ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to update these terms at any time; continued use of the Service constitutes acceptance of any changes.

2. Description of Service

SmartPick is an entertainment platform that generates lottery number suggestions based on statistical frequency analysis of historical draw results. The Service is provided for entertainment and informational purposes only. SmartPick does not guarantee any lottery winnings and is not affiliated with, endorsed by, or connected to the Multi-State Lottery Association, Powerball, Mega Millions, or any government lottery organization.

3. No Guarantee of Winnings

Lottery games are games of chance. Past draw frequencies do not predict or influence future results. Nothing on SmartPick should be construed as a guarantee, promise, or prediction of winning lottery numbers. You acknowledge that purchasing lottery tickets involves financial risk and that you do so entirely at your own discretion.

4. User Accounts

To access certain features you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate information and to notify us immediately of any unauthorized use of your account.

5. Premium Membership

SmartPick offers a one-time Premium membership for $19.95 that grants lifetime access to premium features. All purchases are final and non-refundable unless required by applicable law. Premium access is tied to your account and is non-transferable.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Scrape, copy, or redistribute data from the Service without permission
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service if you are under 18 years of age

7. Intellectual Property

All content, design, code, and data on SmartPick are the property of SmartPick and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

To the fullest extent permitted by law, SmartPick shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including any lottery-related financial losses.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
